Vacation Rental Agreement
Before your vacation begins, please read your Vacation Rental Agreement thoroughly. By making any payments to Sunshine Vacation Rentals (herein referred to as SVR) for the occupancy of our vacation properties, you are agreeing to the full terms of our Vacation Rental Agreement. All policies are strictly enforced and it is the responsibility of all guests, their party members, and any guests or invitees to be familiar with all policies pertaining to the rental.
We have a strict No Tolerance policy for excessive noise, parties, or disturbing neighbors. Please ensure you are comfortable with our terms
DAMAGE PROTECTION PLAN or SECURITY DEPOSIT:
Our properties are inspected before and after each reservation. Guests agree to pay for any flagrant damage to the units, excessive cleaning required at check-out, missing or damage to the units’ content, or any other accidental damage to anything beyond reasonable wear and tear within the rental unit during the rental period. Your reservation was either charged for a Damage Protection Plan Fee to cover up to $1,500 in damage or we collected a deposit. If any damages are above this coverage limit then you authorize any additional charges for said damage and/or missing items to be charged.
Please note: If you booked thru Air B and B, they hold the funds for the security deposit.
RESERVATIONS:
All reservations are subject to approval by Management and Property Owner. Online rates may change without notice, and all online bookings are not confirmed until we call and confirm within 48 hours. If there are any issues with your reservation, you will be contacted within 48 hours
PROPERTY:
You have agreed to lease on a short-term basis, for vacation purposes only, the furnished real property and improvements.
ARRIVAL TIME:
Check-in time is NO EARLIER than 4 pm on.
DEPARTURE TIME:
Check-out time is NO LATER than 10:00 am on. Your prompt departure is appreciated so we can prepare the unit for any incoming guests. If you have not arranged for a late checkout, you may be charged $35 for each hour beyond 10:00 am if you still occupy the property, with a minimum charge of one hour. If the unit has not been vacated by 4 pm, a fee equal to the rental rate of 2 ½ days may be assessed.
FULL PAYMENT REQUIRED AT BOOKING:
Total cost is due to reserve property. A reservation can be made with a 100% payment paid by credit card. The credit card must have an expiration date that extends beyond your stay. If the Guest(s) has no Visa, Master Card, American Express, or Discover Card, a cash payment can be arranged which may include an additional refundable security deposit. This security deposit will be returned within one week of the departure date, provided there is no breakage or damage to the premises and/or contents, there are no outstanding long distance phone or pay-per-view charges, no additional cleaning costs, and all other rules of this agreement are adhered to.
STRICT NOISE ORDINANCE:
No loud noises, music, parties or loud vehicles are allowed between the hours of 9:00pm and 9:00am. Please note if these are not followed, you can be fined and asked to vacate the property without any type of refund.
APPROVED GUESTS, USE AND OCCUPANCY:
The premises are for the sole use of approved guests as a personal vacation residence. The reserving guest is responsible for any additional guests using the property during the rental term. Occupancy exceeding the maximum allowed will constitute a breach of the agreement, leading to immediate eviction and forfeiture of all payments and deposits.
OCCUPANCY:
Approved Guests are persons who will occupy the Premises. No unlawful activity of any other activity that constitutes a nuisance is permitted on Premises. Approved Guests take full responsibility for all lost or broken items, and any damages to the Property of any kind.
CLEANING:
Premises will be delivered to Guest in a professionally cleaned condition. A non-refundable cleaning fee is required with all reservations. This fee is for our housekeepers who dust, vacuum, sanitize, clean linens and towels, maintain the rental and remove refuse from the property. Guest(s) are required to follow all check out procedures detailed in this agreement and leave the property in the same general and good habitable condition it was in when the Guest(s) arrived. Undue and/or unreasonable cleaning of the unit shall be charged to the Guest’s/Cardholder’s credit card as an Additional Cleaning Charge at a rate of up to $45/hour, with a one hour minimum.
LINENS & TOWELS:
Bath towels, sheets, pillows and blankets are provided. We provide beach towels for outdoor use. DO NOT take the unit’s linens or bath towels outside. Bring items with you that you may need for sunbathing outside. Please allow us to wash the unit’s linens unless you need clean linens during your stay. Extra sheets and towels are provided if you are staying a week or longer (otherwise one set per guest are provided where laundry facilities are available).
PETS:
Pets are allowed in CERTAIN units if the applicable pet fees have been paid. Unauthorized occupancy of pets in not pet units will result in immediate eviction and loss of all rents and deposits. If discovery of unauthorized pets is made after your departure, a penalty of $100/day plus any additional cleaning charges will be assessed. If your desired unit allows you to bring a pet the following rules must be followed:

Pay the pet fee, NON-REFUNDABLE

No pets on any furniture or bedding. 2.

Please do your best to remove all pet hair to avoid additional cleaning time/charges.

All waste must be picked up and placed in the garbage cans tied securely in trash bags. (Please remember we don’t have garbage service and housekeepers must remove your trash with their vehicles!)

No pets in the bath tub.

Pets should not be left unattended in unit unless crated.

Damage up to $1500 caused by authorized pets is COVERED if you opted in for the Vacation Rental Damage Waiver! Otherwise, guest assumes full responsibility for any damage caused by pet to be charged to credit card on file.

8. Any extra cleaning that must be done because of pet(s) will be charged to renter at rate of $45 an hour.
NO SMOKING:
Smoking, including vaping, is not permitted in any SVR property. If smoking occurs, guests will be responsible for all related damages, including stains, burns, odors, and debris removal. Violations will incur a minimum charge of $250 for cleaning and mitigation.
CONDITION OF PREMISES:
Guests should inspect the premises upon arrival and immediately report any issues. Reporting does not grant the right to cancel the agreement or receive a refund. No refunds or considerations are given unless issues are reported during the stay.
LOST OR LEFT ITEMS:
Management is not responsible for lost, stolen, or abandoned items. A $25 handling charge plus shipping costs will apply for any items returned at the guest's request.
MAXIMUM OCCUPANCY:
The property cannot be occupied by more than the maximum occupancy specified in the rental agreement. Violations will result in immediate termination of the rental agreement with forfeiture of all rental amounts and deposits
ILLEGAL SUBSTANCES:
No illegal substances are allowed. Minors should not possess alcohol. Violations will result in eviction with no refunds.
UTILITY ISSUES
Non-usability of utilities such as power, phone, satellite, or internet due to issues beyond our control does not warrant a refund.
PLUMBING:
Do not dispose of feminine products in the toilet or grease down the drain. Use plungers provided for any clogs.
SYSTEM FAILURES:
Management will attempt to repair or replace failed systems promptly. No refunds will be given for such failures.
NO COMMERCIAL USE:
The property is for personal vacation use only. Commercial activities and nuisances are prohibited.
MAINTENANCE AND REPORTING:
Guests must properly use and safeguard the premises and report any issues immediately. Guests are responsible for damage resulting from failure to report issues promptly.
RIGHT OF ENTRY:
SVR reserves the right to enter the property at any time to investigate disturbances, check occupancy, inspect for damages, or make repairs.
TERMINATION OF OCCUPANCY:
Upon termination, guests must return all keys, vacate the premises, and deliver the property in the same condition as upon arrival.
WEATHER/MOTHER NATURE:
Guests release SVR and owners from liability for injury, death, or property damage related to the use of the property.
PERSONAL PROPERTY AND INJURY:
Guests are responsible for their personal property and injury. SVR recommends obtaining insurance for protection.
COVID-19 NOTICE:
While Management professionally cleans each property prior to its rental, we do not perform a cleaning such that we can warrant the elimination of viruses, including but not limited to the COVID-19 virus. Neither Management nor Owner represents, warrants or guarantees that the cleaning process will result in the Premises being COVID-19 virus free. As the Reserving Guest, you acknowledge and agree, on behalf of yourself and all of your guests, invitees, licensees and all other persons brought onto or into the Premises, that you indemnify, defend and hold harmless Owner and Management from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage, death or injury to Reserving Guest, guests or licensees or their personal property in any manner related to the COVID-19 virus. This indemnification and hold harmless is a material consideration in SVR and the Owner agreeing to rent the property to you.
MEDIATION:
Guest agrees to mediate any dispute or claim arising out of this Agreement, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among parties involved.
JOINT AND INDIVIDUAL OBLIGATIONS:
If there is more than one Guest, each one shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other Guest.
ENTIRE CONTRACT:
This agreement constitutes the entire contract between parties and is governed by California law.
RELEASE:
In consideration of the right to visit the home, Guest agrees to release to the fullest extent allowed by law, Owner and its Management, members, officers, associates, employees, agents, representatives, attorneys, assigns, and affiliates (collectively, the Affiliates) from all liability or responsibility of any kind whatsoever for any personal injury, death, property damage or other loss sustained by me, my minor children, any guest identified on this form, or any guest or person allowed onto the property during my rental dates as a result of my, my children or the guests participation in a visit to the home, due to any cause whatsoever, including without limitation negligence on the part of Owner or Management . I understand that this release will bind my heirs, administrators, executors, and any other person or entity seeking to claim under or through me.
EMERGENCIES/ MAINTENANCE:
Contact Guest Services for any issues. Urgent situations outside office hours may be directed to Vacation Rental Maintenance.
CHECK OUT CLEANING REQUIREMENTS:
A starter supply of expendable supplies such as paper goods and soap is provided; please bring additional if you feel this will not be adequate. Basic cleaning supplies are stocked to do your own cleaning during your stay. Housekeeping is not provided during your stay unless previously arranged. Failure to comply with pre-departure cleaning requirements resulting in excessive cleaning will be charged to your credit card at $45/hour, with a one-hour minimum.

Place soiled towels in the bathtub.

All dirty dishes, cookware and eating utensils should be washed, rinsed, dried and put away in the proper location.

Floors should be in generally good condition and ready to be vacuumed by our housekeepers.

All household trash, garbage, recycling and/or other discarded items should be properly bagged up to avoid spillage/leakage, and deposited in the proper refuse containers provided. Please do your best to help us recycle by hauling it out with you.

Refrigerator and microwave should be left clean and free of food.

All appliances (stove, oven, BBQ, etc.) should be left in a clean condition and free of spills and grease.

Please wipe down counters and other surfaces.

All litter must be picked up from the premises and placed in the outside garbage cans, tied securely in trash bags.

Please try not to leave any pet hair in the home! Duct tape works great on furniture and may be provided with our other cleaning supplies.

GLITTER AND CONFETTI ARE NOT ALLOWED AT ANY PROPERTY, INSIDE OR OUTSIDE.
SECURITY & SAFETY RISKS: ALWAYS LOCK DOORS AND WINDOWS WHEN YOU LEAVE THE UNIT!
Always lock doors and windows. SVR is not responsible for lost key replacement costs. Supervise children at all times.
TERMS AND CONDITIONS
A completed “Vacation Rental Agreement” is required within 24-hours to hold your reservation. The Rental Deposit is due upon receipt. Review and acceptance of the Sunshine Vacation Rentals & Conditions which is made part of this rental agreement is required before a confirmation will be issued.

CANCELATIONS AND REFUNDS:
Cancelations that are made more than thirty (30) days prior to the arrival date will incur a $500 administrative restocking fee. Cancelations or changes that result in a shortened stay, that are made within 30 days of the arrival date, forfeit the full advance payment (not including deposit and cleaning fee). Cancelation or early departure does not warrant any refund of the payments that have been made. Cancelations or reschedules made with less than 30 days’ notice will result in 100% loss of all payment less any security deposit or cleaning fee. All reservation changes must be acknowledged in writing.
UNAVAILABILITY:
If the property becomes unavailable, SVR may substitute a comparable unit or cancel the agreement and refund all payments.
ACKNOWLEDGEMENT:
I/we, the undersigned, hereby apply for the above listed accommodation and warrant that I/we have read, understand and agree to the terms and conditions of this application, and I/we agree to abide by homeowners/agents/association restrictions on use of said property. I/we further understand and represent that I/we are executing this application on behalf of all parties named on the guest list.
INITIAL RENTAL CHARGES WILL BE AUTOMATICALLY CHARGED TO THE CARD YOU PROVIDED AT THE TIME OF BOOKING
It is hereby agreed that unpaid rent, excessive cleaning, damage, lost keys or lock-outs may be charged to this card if necessary. I agree that this is a legally binding document and I have read all terms and conditions in this document.
